Trade Accounts

Introduction
By signing up for a trade account ("Account") on our lighting app for design professionals and companies ("App"), you agree to be bound by the following terms and conditions ("Terms").

These Terms apply to all design professionals and companies that sign up for an Account on the App. Please read these Terms carefully before proceeding to use the Account.

Eligibility
To be eligible for a trade account, the applicant must:

a) Be a design professional or a design-related company.
b) Possess a valid federal tax ID.
c) Be at least 18 years of age or older, or the age of majority in their jurisdiction of residence, whichever is greater.

Sales Tax Exemption
If the applicant wishes to claim sales tax exemption, they must provide a current and valid sales tax certificate from their state of residence. The sales tax exemption will only apply to purchases made through the Account, and any misuse of the exemption may result in the suspension or termination of the Account. Sales tax certificates must be updated annually upon expiration by the applicant.

Account Registration
To register for a trade account, the applicant must provide accurate, complete, and up-to-date information as requested in the registration process, including but not limited to, the applicant's name, company name, federal tax ID, contact information, and sales tax certificate (if applicable). The applicant is responsible for maintaining the confidentiality of their Account login credentials and for all activities that occur under their Account.

Account Benefits
Trade account holders may receive various benefits, including, but not limited to, exclusive discounts, promotions, priority customer service, and access to special events. We reserve the right to modify, add, or remove any benefits at any time without prior notice.

Usage and Conduct
The trade account holder agrees to use the App and the Account in accordance with all applicable laws, rules, and regulations. Any fraudulent, abusive, or otherwise illegal activity may result in the immediate termination of the Account and possible legal action.

Termination
We reserve the right to terminate or suspend the Account, at our sole discretion, with or without cause, and without prior notice. Reasons for termination may include, but are not limited to, violation of these Terms, fraudulent activity, or misuse of the Account.

Intellectual Property
All intellectual property rights, including but not limited to trademarks, copyrights, and patents, in the App and its content are owned by or licensed to us. The trade account holder may not copy, reproduce, distribute, or otherwise use any such intellectual property without our prior written consent.

Limitation of Liability
In no event shall we, our affiliates, or any of our respective officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the use of the App or the Account, whether based on warranty, contract, tort (including negligence), or any other legal theory.

Indemnification
The trade account holder agrees to indemnify, defend, and hold us, our affiliates, and our respective officers, directors, employees, and agents harmless from and against any and all claims, damages, losses, costs, or other expenses (including reasonable attorneys' fees) that arise directly or indirectly out of or from the trade account holder's breach of these Terms or their use of the App or the Account.

Modifications to Terms
We reserve the right to modify these Terms at any time without prior notice. Any changes will be effective immediately upon posting, and the continued use of the App or the Account after such modifications will constitute acceptance of the revised Terms.

Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which our company is registered, without regard to its conflict of law provisions. The trade account holder agrees to submit to the personal and exclusive jurisdiction of the courts located in the same jurisdiction for the resolution of any disputes arising out of or relating to these Terms or the use of the App or the Account.

Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect, and the invalid or unenforceable provision shall be deemed modified to the minimum extent necessary to render it valid and enforceable.

Waiver
No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

Entire Agreement
These Terms, together with any other agreements, policies, or terms incorporated by reference, constitute the entire agreement between the trade account holder and us concerning the use of the App and the Account and supersede all prior or contemporaneous communications, proposals, and agreements, whether electronic, oral, or written, between the parties.

Brand Lighting is not responsible for outdated or inaccurate pricing on other websites, affiliates or advertisers. We appreciate being notified when such errors occur so they may reported and corrected quickly. We appreciate your understanding and assistance in this matter.



Returns

If you are unsatisfied with the purchased merchandise and it has not been installed you may be able to return it. Under these conditions please contact Brand Lighting for a Returned Goods Authorization number within thirty (30) days of receiving the product. The product returned with a Brand Lighting RGA will be accepted for credit less a 15% to 50% restocking fee and shipping fees. Please contact us prior to placing your order to confirm return terms for the manufacturer's selected.

If you have any questions about this policy or the restocking fee that will apply to your particular item, please contact Brand Lighting customer service for additional Returns & Exchange information before placing an order.

You may return most new, unopened items within 30 days of delivery for a refund. We'll also pay the return shipping costs if the return is a result of our error (you received an incorrect or defective item, etc.).

The cost of the return shipping will be deducted from the credit amount. In other words, you are responsible for the return shipping cost of any item you return.

The product must be returned in its original condition with all parts intact. A credit will not be issued if it is not the original product. Replacement or repair of defective product after thirty (30) days of receipt of shipment will be handled under manufacturer's warranty only. Please contact us for the manufacturer warranty terms and conditions prior to placing an order..

You should expect to receive your refund within four weeks of receipt of your item by Brand Lighting, however, in many cases you will receive a refund more quickly. This time period includes the transit time for us to receive your return from the shipper (5 to 10 business days), the time it takes us to process your return once we receive it (3 to 5 business days), and the time it takes your bank to process our refund request (5 to 10 business days).

If you need to return an item, please use form on the Contact Us page with your order number and details about the product you would like to return. We will respond quickly with instructions for how to return items from your order.

The Following Can NOT be accepted for Returns:

    • Products that have been clearly identified as non-returnable on the Product Details Page

    • Products that have been installed or assembled

    • Products that are not in the original condition and packaging

    • Products with unwrapped crystals

    • Products that are Made-to-Order, Custom or Special Order to your specifications

    • Light Bulbs

    • Large quantities of the same product (6 or more)

    • Open-Box items or Clearance merchandise

Shipping

We can ship to virtually any address in the world. Note that there are restrictions on some products, and some products cannot be shipped to international destinations.

When you place an order, we will estimate shipping and delivery dates for you based on the availability of your items and the shipping options you choose. Depending on the shipping provider you choose, shipping date estimates may appear on the shipping quotes page.

Please also note that the shipping rates for many items we sell are weight-based. The weight of any such item can be found on its detail page. To reflect the policies of the shipping companies we use, all weights will be rounded up to the next full pound.

Most shipping for domestic orders is via UPS. A per-item shipping fee is quoted based on the weight of the order.

International orders are delivered to your choice of freight forwarders for a fee to be agreed upon at the time the order is placed. Please contact us to arrange an alternate shipping method if desired.
Customs, Duties, GST, VAT, or any other import taxes are the responsibility of the customer.

Our in-stock items ship to you within three business days. Please contact us for more information. Inquiries will typically be responded to by our warehouse staff within 24 hours, except on Sunday.

*FREE SHIPPING within the continental United States is available where noted. Other products also qualify for FREE SHIPPING. Contact our Sales staff at 888-991-3610 for specifics.  Furniture does not qualify for Free Shipping.


Custom Order

Once an order has gone into production, it is not subject to cancellation. Free shipping may not apply to custom orders. All custom orders are Final Sale. No returns. No refunds. Fine Art, Fire Farm, Van Teal, Harco Loor and Scan Gift are all custom orders. All orders that ship directly from the factory are to be paid in full in at the time of order. 

Please note that made-to-order items, custom items, and specialty items are not returnable or refundable. Made to Order items, once in production, may not be cancelled. We highly recommend contacting us prior to placing your order to confirm whether returns or refunds are available for your specific item.

Payment Methods

We accept VISA, MC and DISCOVER. Please contact us if you desire to pay by other means.

Brand Lighting will send your order to confirm in PDF format. In order to view PDF files on your computer, you must have a PDF reader program installed.

Overstock & Sale

Sale prices will only be honored for sales orders confirmed before end of sale. Some quantities are limited.

Sale items may return to regular price after promotional period. Sale items are subject to special return and exchange restrictions per manufacturer. For complete and detailed return and exchange information on sale items please call our customer support representatives at (888) 991-3610.

Clearance items will be available until manufacturer no longer has stock. Clearance items are discontinued stock and no returns or exchanges will be accepted.

Clearance items are all new, unused items, unless otherwise specified. Clearance items are items that are either being discontinued or showroom display items.

Quantities are limited and only available while supplies last. No refunds, credits or discounts will be retroactively offered for previously purchased sale or clearance items.

Unless otherwise specified, all Clearance sales are final, no exchanges, refunds or returns.

Overstock, Sale and Clearance items are guaranteed to be in new, working condition and without defect unless otherwise specified.

Overstock, Sale and Clearance items come with the original manufacturer's warranty.

It is unlikely, but if a clearance item does arrive with minor defects and there is no remaining stock, Brand Lighting will provide what is needed to correct the problem. If the defect is not minor, the fixture can be returned to Brand Lighting to be repaired or a full refund will be issued.

Sales Tax

Internet companies with a physical presence in a state are required to collect and report sales taxes on sales made to customers living within that same state.

Some products that are shipped direct collect sales tax.

Tech Lighting to California 8.25%
Tech Lighting to Illinois 8.75%
Basic Source Architectural Lighting to California 7.5%
Our showroom and warehouse are located in Florida. We collect sales tax on purchases from Florida shipped to Florida addresses.

Defective Items

Please inspect your lighting as soon as you receive it. If you have received damaged merchandise contact Brand Lighting Returns immediately.

The person listed as the "Ship To" is responsible for filing any freight claims within 3 days of receiving merchandise. We are not responsible for manufacturer delays. The people listed as "Bill To" assume responsibility for any applicable sales tax, freight and handling charges. If you have any questions about whether these policies apply to your order, please contact Brand Lighting Returns.

Brand Lighting is not responsible for any labor costs as the result of the installation of wrong or defective merchandise.

Most of the time fan or lighting problems can be solved by calling the manufacturer's technical support telephone number. If they cannot solve the problem Brand Lighting will repair or replace a damaged or defective product. If inventory is unavailable, Brand Lighting will issue a full refund after you have returned the damaged or defective product.

Before returning any merchandise please contact via the contact page form or via phone 888-991-3610 for a Returned Goods Authorization number.

Pricing

Occasionally there are errors in pricing on this site. If this happens, we reserve the right to cancel your order. A complete refund will be made for any items that have not yet been shipped. In the event of inaccurate product information, our sole responsibility will be to accept the product return and provide a customer refund.
